Privacy Policy

PRIVACY POLICY AND DATA ASSET DISCLOSURE
ROCKAWAY RIVER COUNTRY CLUB Version 1.0 | Effective Date: May 12, 2026
 
I. PREAMBLE AND SCOPE OF AGREEMENT
This Privacy Policy (the "Policy") constitutes a legally binding agreement between Rockaway River Country Club ("the Club," "we," "us," or "our") and the authorized Member ("Member," "User," or "you") regarding the collection, transmission, and preservation of Personal Information through the Rockaway River Country Club Mobile Application (the "App"). This App is a proprietary utility provided via a licensing agreement with Jonas Software ("Service Provider").
Access to the App is strictly contingent upon active Membership in good standing. This Policy is incorporated by reference into the Club’s Bylaws and Rules and Regulations.

II. CATEGORIES OF PERSONAL INFORMATION COLLECTED
We collect information that identifies, relates to, describes, or is reasonably capable of being associated with an individual. This includes, but is not limited to:
  • Personally Identifiable Information (PII): Legal name, member identification number, residential and billing addresses, personal electronic mail addresses, and primary cellular telephone numbers.
  • Sensitive Geolocation Data: Utilizing Global Positioning System (GPS) and "geo-fencing" technology, the App may collect precise real-time location data to facilitate point-of-sale efficiency (e.g., "Food and Beverage Ordering at the Turn"), Pace of Play analytics, and course navigation.
  • Financial Instrument Data: While the Club maintains records of monthly statement balances and transaction histories, all credit card and ACH data are processed via PCI-DSS compliant third-party gateways. No full Primary Account Numbers (PANs) are stored on Club-controlled local infrastructure.
  • Technical Identifiers: Internet Protocol (IP) addresses, unique device identifiers (UDID), browser types, and interaction telemetry (logs of features accessed and duration of session).
 III. PURPOSES OF DATA PROCESSING
The Club processes Member data under the following legal bases:
  1. Contractual Necessity: To perform services requested by the Member, including but not limited to dining, court and Performance Center reservations, event and tournament registration, lesson booking and.
  2. Legitimate Interests: To facilitate the Member Directory, which serves as informational and a social networking utility for the membership.
  3. Safety and Security: To ensure the integrity of the Club’s physical and digital perimeter, preventing unauthorized access to Club facilities and data assets.
IV. DATA SHARING AND THIRD-PARTY INTERMEDIARIES
The Club does not engage in the sale, lease, or trade of Member Personal Information to third-party marketing firms. Information is disclosed exclusively to:
  • Jonas Software: As the primary Data Processor, Jonas Software manages the backend integration (Jonas ARC™). Their data handling is governed by their own corporate policy, available at https://www.jonasclub.com/privacy-policy/.
  • Affiliated Modules: Specialized third-party integrations (e.g., Golf Genius, GHIN, or dining management platforms) that are contractually bound to maintain data confidentiality.
  • Legal Mandates: When required by subpoena, court order, or New Jersey state law to protect the Club’s legal interests or the safety of its Members.
V. MEMBER AUTONOMY AND PRIVACY CONTROLS
The Member maintains the absolute right to limit the dissemination of their information within the social ecosystem of the Club:
  • Directory Opt-Out: Members may, at their discretion, toggle the visibility of their cellular numbers, email addresses, and residential data within the "Profile Settings" of the App.
  • Geolocation Permissions: Precise location tracking is an opt-in feature. Consent may be revoked at any time via the hardware system settings of the Member’s mobile device.
  • Right to Rectification: Members have the right to request the correction of inaccurate data held within the Jonas Software database.
VI. DATA SECURITY PROTOCOLS
The Club employs a "Defense-in-Depth" security strategy. This includes, but is not limited to, Secure Socket Layer (SSL) and Transport Layer Security (TLS) encryption for all data in transit. Administrative access to Member data is restricted to "Need-to-Know" personnel who have undergone privacy training. Notwithstanding these measures, the Member acknowledges that no digital transmission can be guaranteed as 100% immune to breach.

VII. JURISDICTIONAL COMPLIANCE (NEW JERSEY)
This Policy is designed to comply with the New Jersey Data Privacy Act (NJDPA) and other applicable state and federal statutes. In the event of a conflict between this Policy and a mandatory provision of law, the latter shall prevail.

VIII. AMENDMENTS AND NOTIFICATION
The Club reserves the right, in its sole discretion, to amend or modify this Policy at any time. Notice of significant changes will be disseminated via push notification and/or the email address associated with the Member’s account. Continued use of the App following such notification constitutes an express acceptance of the revised terms.

IX. PROTECTIONS FOR MINORS AND CHILDREN’S PRIVACY
Rockaway River Country Club is committed to protecting the privacy of our younger members. This section is provided in compliance with the Children’s Online Privacy Protection Act (COPPA) and relevant state statutes.
  1. Minimum Age for Account Creation: The App is intended for use by adult Members and their authorized dependents. We do not knowingly permit children under the age of thirteen (13) to register for an App account independently. Any access provided to a minor must be initiated and authorized by a parent or legal guardian who is a Member in good standing.
  2. Collection of Information from Children: We do not knowingly collect, store, or solicit Personal Information from children under the age of 13 through the App without verifiable parental consent. In the event that a minor under the age of 13 uses the App (e.g., for viewing a family statement or checking event schedules), such data is treated as part of the primary Member’s family record within the Jonas Software ecosystem.
  3. Parental Rights and Control: Parents or legal guardians maintain the right to review, edit, or request the deletion of any Personal Information related to their minor children. If you believe that a child under 13 has provided the Club with PII without parental consent, please contact the Privacy Compliance Liaison immediately so that we may take appropriate steps to remove such information and terminate the unauthorized account.
  4. Geolocation and Minors: Precise location tracking and geo-fencing features are disabled by default for accounts identified as belonging to minors, unless a parent or guardian specifically enables such features for safety or course-utilization purposes (e.g., Junior Golf programs).
  5. Safe Directory Practices: To ensure the safety of our Junior Members, the Club’s policy is to restrict the visibility of minors in the Member Directory. Contact information for minors will not be displayed to the general membership unless a parent or guardian explicitly opts-in to such visibility for club-related social purposes.
